Is this considered spamming?

I'm hoping someone can answer my question. I submitted my website http://PixieandthePrince.biz over two years ago and it's still not listed.
I believe it was last awaiting review here: http://dmoz.org/Shopping/Gifts/Personalized/Embroidery/

Alot has changed in that time and I've just moved the site to http://PixieandthePrince.com for many reasons.

My question is should I submit .com, or would I be penalized for spamming? I'd prefer the old submission to be deleted as it's way outdated if even awaiting review, but wasn't sure how to proceed.

You may submit the .com to the single best category. Instead of offering a description, use the space as follows: [replaces the submission of http://pixieandtheprince.biz which was submitted to category name.]

This lets the reviewing editor know that this is the submission you prefer.

from your index page gives a 404 (Page not found)

Ah, that is one of the biggest presumptions among editors, at least, that I've witnessed so far. In a good number of categories, on a good number of occasions, one cannot find the single best category. When you peruse the Directory the following existential question arises pretty often. "If my single best category presently has only lions, tigers and hyenas, where do I place my lamb?".

Your question hints at a possible loophole, opening the way for sabotage. Couldn't some joker reading this forum now submit your site 5 times, making it a spammer?

The intent of the statement is that you should submit to only one category*. You are asked to chose the one which you think is best, rather than submitting multiple copies of you sites to all the catgories which you think may be the right one. Assuming you have found at least one believed-suitable category, toss a coin if you really can't decide which to submit to. If you can't even find one category that's even remotely suitable, then I guess you're stuck... Try looking again, try using the search function to look at where similar sites are already listed, ...

If the submitted-to category isn't right, then editors will move the site to the one that is. It just creates more work for us if we have to also delete multiple copies of the same site submitted all ove the place.

* There are some exceptions to this, sich as being allowed one submission in non-regional and one in regional (assuming your site is appropriate for both) and also a separate submission under World/ for each (human translated) language you offer your content in.

Nice to know. Thanks. Do you occasionally restructure the existing categories or create new ones in order to accommodate new sites for which no appropriate category exists?

Most categories don't allow submissions "one level up", which is where everyone would rather be (in my field, at least -- Adult). That is why we come "down" in the first place.

There are a lot of reasons for creating a sub-category. If I am the editor, and I have a specie that is unique, I would create a sub-category for that otherwise it is one level up as said or if you have at least 3 species of similar kind then I would create a sub-category for that too. But it all depends on the editor on that certain category.
Do you occasionally restructure the existing categories or create new ones in order to accommodate new sites for which no appropriate category exists?
Yes and the variables of creating a new sub-category would be up to the editor if it seems that a new site does not fit into an existing category. But then again it should be a very unique specie or at least 3 species of similar kind.
