Might have made a mistake

Several Weeks ago I submitted my site directly to dmoz I realized I had submitted to a mass list service pay program also, my question is will I be penalized if this pay service also submitted my site to dmoz?

At the time I wasn’t aware they submitted the site to dmoz along with the commercial sites

No, you won't be penalized.

If they submit to the one best category in a Topical subject and another for a Regional location, then you shouldn't have any problems.

However, if they start re-submitting multiple entries every few weeks or months, multiple deeplinks to multiple categories, then the word spam might start to be associated with your site. Make sure your program is not one of those types, before it is too late.
