Need Help Getting Fraudulent Site out of Directory

Who are the meta-editors that I could contact to get a site out of the directory? There is a site that has hijacked the Trademarked Name of a company I represent, in the directory and I need to get it out quickly.

Have your lawyers contact AOL's lawyers -- regular editors aren't in a position to know about or judge or act upon such legal issues.

Hi, This is something that is a blatant violation that the dmoz editor could/should have picked up on. Is it ok to give specific information? Basically they are using the trademarked name as the Title, but the URL is going to a different site.

We are suing this company also btw, but that is because they are using my client's trademarked logo on their site, e-mail, stationary, etc..

My main concern is the blatant use of the trademarked name in the title in the odp, and i think its something that a regular editor should be able to do something about, hopefully.

You probably need to take this up with the NIC registrar. IANAL, but I'd bet the AOL/TW lawyers would eventually get around to telling your client that the NIC thinks the other guy owns the domain name -- and we don't list trademarks, we list websites by domain name.

While the lawyers are swarming, we lay low. If you get rights to the domain name, and the site goes down, then we'd get involved to change or remove the no-longer-functional listing.

If the trademark in the ODP title is really in the site's title, then we shouldn't change it yet.

When you get the judgment (I'm assuming you will if the case is as blatant as you describe), they'll have to change the site. Then you can send a copy of the judgment to AOL/TW lawyers, and in a few days (or weeks) it'll percolate down to the editors. But at that point you can reasonably request a change from us also -- on the grounds that the ODP title is inaccurate. That we can handle.

Fair enough, but i thought i'd get a jump on it while its still being taken care of by the lawyers. I'm being contracted now to take over the website's online marketing etc.. and when i went to submit them to DMOZ i see this other jerk is already in there. The fact that my proposed listing's title will already be in the directory won't affect it being accepted will it?

We have many categories holding groups of sites with _identical_ titles. That's not an issue.

When you submit the site, you might include a note about the other url with the same title and explain that you aren't the same company. Identical titles does set editors to looking to see if the sites are related/mirrors or such.
